Description of Services

SCALE is a turnkey business scaling system that fights for every client, turning every dollar of advertising budget into profit.

Our platform integrates with the WhatsApp Business API to provide a complete solution for business automation and growth.

Terms of Access

• Non-transferable license to use the application
• Access is provided individually for each Client and their Facebook Business Manager
• Access may be revoked at any time at our sole discretion (in particular, for violation of these Terms, by law, or in case of technical issues)
• Territory: worldwide

Compliance Requirements

Users MUST comply with:

• Meta’s Terms of Service
• WhatsApp Business Solution Terms
• Facebook’s Acceptable Use Policies
• All applicable laws in their jurisdiction (regularly check and comply with current versions)

User Obligations and Acknowledgments

By using SCALE, you expressly acknowledge and agree that:

1. You bear sole and full responsibility for:
• The content of all messages sent through the system
• Compliance with all applicable laws and regulations
• Obtaining all necessary consents from your end users
• Ensuring the security of your account credentials
• The accuracy and quality of data
• All interactions with platforms integrated through SCALE (including, but not limited to, Facebook, WhatsApp, and other third-party services)
• Any data processing or storage performed by integrated services
• Compliance with the terms of use of all integrated platforms
2. You understand that:
• We provide only technical infrastructure
• We do not review, endorse, or control the content of your messages
• We make no representations about the legality of your use cases
• We do not provide templates or content recommendations
3. You will not use the service for:
• Any purposes prohibited by Meta/Facebook
• Any illegal activities
• Distributing malicious, offensive, or prohibited content
• Spam or unsolicited messages

Data Collection and Processing

By using SCALE, you acknowledge and agree that we collect and process the following data:

1. Technical Data from WhatsApp/Meta Integration

• WhatsApp Message ID and system message identifiers
• Message statuses (sent, delivered, read)
• WhatsApp users’ phone numbers and profile names
• Message types (text, image, video, location, contact)
• Timestamps of message receipt
• Template statuses (approved, rejected, suspended)
• Campaign information and sending statistics
• Account events (WABA status, policy violations, restrictions)
• Referral data (ad URL, source type, ad ID)
• Technical connection metadata (app name, API version)
• Conversation pricing information (marketing/authentication/utility/service)
• Product and catalog information
• Address data (city, postal code, street)

2. Purposes of Data Processing

• Ensuring the functionality of the WhatsApp Business API integration
• Delivering messages and notifications via WhatsApp
• Analyzing the effectiveness of templates and campaigns
• Complying with Meta/Facebook and WhatsApp requirements
• Providing analytics on service usage

3. Data Retention Periods

• Technical metadata is stored for the entire duration of service use and 30 days after termination
• Message history is stored in accordance with Meta’s policies

4. Data Transfer to Third Parties

• Data is transferred to Meta/Facebook and WhatsApp as part of the necessary integration
• We do not transfer your data to other third parties, except as required by law

5. Compliance with Data Protection Laws

• You must comply with all applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR), when using the service and processing personal data through SCALE
• You are fully responsible for obtaining the necessary consents from your end users for the processing of their personal data in accordance with GDPR, CCPA, and other applicable data protection laws.

Intellectual Property

All intellectual property rights related to the SCALE application (including, but not limited to, software, design, trademarks) belong to RAKHNIANSKII LTD. The user is granted only a non-transferable license to use the application in accordance with these Terms.

Service Limitations

We reserve the right to:

• Modify the service without notice
• Update these terms at any time (including to reflect changes in Meta, Facebook, and WhatsApp policies)
• Restrict or deny access to the service
• Require version updates

Disclaimer

SCALE is not responsible for:

• Loss of access to Facebook/WhatsApp API for any reason
• Losses related to changes or disabling of Meta features
• Confiscation of accounts or advertising budgets
• Any third-party claims related to user content
• SCALE bears no financial obligations to users or third parties.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses, including, but not limited to, reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your violation of any rights of another.

Termination of Access

We may terminate your access to the service immediately, without prior notice or liability, for any reason, including, but not limited to:

• Violation of these Terms
• At your request
• If required by law
• If you engage in any conduct that we determine, in our sole discretion, violates these Terms or harms any other party

Force Majeure

We are not responsible for any failures or delays in our performance under these Terms caused by any reason beyond our reasonable control.

Applicable Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any legal actions or proceedings arising in connection with these Terms shall be brought exclusively in the courts located in England.
